1. Acceptance of Terms

By downloading, installing, or using the Haika application ("the App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App. Continued use of Haika constitutes your acceptance of any modifications to these Terms.

2. Description of Service

Haika is a self-care and emotional wellness application that offers:

  • Animated virtual pets that react to your emotional state.
  • AI-powered chat for reflection and companionship.
  • Voice notes with transcription and micro-action plans.
  • Brief mindfulness and gentle movement rituals.
  • Optional integration with health data (Apple HealthKit / Google Health Connect).

Haika is NOT a medical, therapeutic, or professional mental health service. The App does not diagnose, treat, or prevent diseases. It is not a substitute for professional mental health care. If you are in crisis, please contact your local emergency services.

3. Eligibility

To use Haika, you must:

  • Be at least 13 years of age (or the minimum legal age in your jurisdiction).
  • Provide truthful information when creating your account.
  • Use the App exclusively for personal, non-commercial purposes.

4. User Accounts

You are responsible for maintaining the confidentiality of your account and password. We reserve the right to suspend or delete accounts that violate these Terms or that show fraudulent activity.

5. Subscriptions and Purchases

Haika offers subscription plans (Free, Pro, and Premium):

  • Auto-renewal: Pro and Premium subscriptions automatically renew at the end of each billing period (monthly), unless you cancel at least 24 hours before the renewal date.
  • Management and cancellation: You can manage or cancel your subscription from your account settings in the App Store (Apple) or Google Play Store (Android).
  • Free trial: If a free trial period is offered, it will automatically convert to a paid subscription at the end of the trial unless you cancel beforehand.
  • Price changes: We reserve the right to adjust prices. We will notify you in advance before any change affects your active subscription.

6. Refund Policy

Refunds are governed by the policies of the store where you made the purchase:

Haika does not process payments directly and cannot issue refunds independently.

7. AI-Generated Content

Chat responses, suggestions, and micro-plans generated by the App use artificial intelligence models. Please be aware that:

  • AI responses are for general guidance and companionship only and do not constitute professional advice.
  • AI may generate inaccurate or incomplete responses.
  • You should not make medical, legal, or financial decisions based on the App's responses.
  • Haika does not guarantee the accuracy, suitability, or completeness of AI-generated content.

8. Acceptable Use

By using Haika, you agree not to:

  • Use the App for illegal or unauthorized purposes.
  • Attempt to access other users' accounts.
  • Reverse engineer, decompile, or disassemble the App.
  • Use the App to generate harmful, abusive, or offensive content.
  • Interfere with the normal operation of servers or infrastructure.
  • Use bots, scrapers, or other automated means to access the App.

9. Intellectual Property

All content in Haika — including but not limited to design, code, virtual pets, animations, text, graphics, and interfaces — is the property of Etchcode and is protected by intellectual property laws. No ownership rights in the App are granted to you beyond the limited license for personal use.

10. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Haika is provided "as is" and "as available", without express or implied warranties.
  • We do not guarantee that the App will be available continuously, error-free, or secure at all times.
  • Etchcode shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the App.
  • Our total liability shall not exceed the amount you have paid for the subscription in the last 12 months.

11. Account and Data Deletion

You may request the deletion of your account and all your personal data at any time from the App's settings or by contacting us via email. We will process your request within a maximum of 30 days.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or by email. Continued use of Haika after notification constitutes your acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Mexico. Any dispute shall be resolved in the competent courts of Mexico City.
